These Terms of Use (“Terms”) govern your access to and use of Joggerz (“the App”), provided by Gorkha Labs (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements under applicable law to use the App. If you use the App on behalf of an organization, you represent that you have authority to bind that organization.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with any app store rules that apply to your download.
3. Acceptable use
You agree not to:
- Use the App in any unlawful manner or in violation of third-party rights;
- Attempt to reverse engineer, decompile, or circumvent security or usage limits;
- Upload malware or interfere with the App's operation or other users' use;
- Use automated means to access the App in a way that imposes an unreasonable load on our systems.
4. Health and fitness disclaimer
The App is intended for general fitness and wellness information. It is not medical advice, diagnosis, or treatment. Always consult a qualified professional before starting or changing an exercise or health program. You use the App at your own risk.
5. Intellectual property
The App, including its design, text, graphics, and software, is owned by Gorkha Labs or its licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted to you.
6. Third-party services
The App may integrate with third-party platforms (such as app stores or device health APIs). Your use of those services may be subject to separate terms from those providers.
7. Subscriptions, billing, and auto-renewal
Joggerz may offer auto-renewable subscriptions (for example, monthly or yearly plans, or other durations shown in the App or on the storefront at the time of purchase) to access premium features. Subscription offerings, prices, and trial terms (if any) are presented at purchase and may change where permitted by Apple or Google and applicable law.
Payment. Payment for subscriptions is charged to your Apple ID account or Google Play account at confirmation of purchase, through the applicable app store. We do not directly charge your payment card for those purchases.
Auto-renewal. Unless you turn off auto-renewal at least 24 hours before the end of the current subscription period, your subscription will automatically renew for the same term. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price unless otherwise communicated as required by the platform.
Managing and canceling subscriptions. You may manage or cancel your subscription at any time through your device settings: on Apple devices, use Settings → [your name] → Subscriptions (or the App Store account subscription management screen); on Android, use the Google Play Store → Payments & subscriptions → Subscriptions (or equivalent). Canceling stops future renewals; you typically retain premium access until the end of the current paid period unless the platform states otherwise.
Free trials. If a free trial is offered, any unused portion may be forfeited when you purchase a subscription, as disclosed at the time of the offer and in accordance with Apple or Google rules.
Refunds. Refund requests for purchases through Apple or Google are handled only by those platforms under their policies; we cannot process refunds for those third-party charges ourselves.
8. Disclaimer of warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation.
9. Limitation of liability
To the maximum extent permitted by applicable law, Gorkha Labs and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the App. Our total liability for claims arising from these Terms or the App shall not exceed the greater of amounts you paid us for the App in the twelve months preceding the claim or one hundred local currency units, where permitted.
10. Indemnity
You agree to indemnify and hold harmless Gorkha Labs from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms, where permitted by law.
11. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or harms other users, us, or third parties. You may stop using the App at any time.
12. Changes
We may modify these Terms from time to time. We will post updated Terms on this page and update the “Last updated” date. Continued use after changes may constitute acceptance as allowed by law.
13. Governing law
These Terms are governed by the laws applicable in India, without regard to conflict-of-law principles, unless mandatory consumer protections in your country require otherwise.
